SiGuardiaPro's SafeSignal App

SiGuardiaPro's SafeSignal is a Mobile Application designed in the United States of America.

1. License Grant & Usage Rights

SiGuardiaPro's SafeSignal grants you a non-exclusive, non-transferable, revocable license to use this application solely for your personal safety and emergency management purposes. You may not: • Reverse engineer, decompile, or attempt to derive the source code of the application • Copy, modify, or create derivative works based on the application • Redistribute, lease, lend, or sell the application or any part thereof • Use the application for commercial purposes or competitive advantage • Access or use the application through any automated means without explicit permission Any unauthorized use of the application is prohibited and constitutes a material breach of this agreement.

2. Developer/Owner Liability Limitation

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SiGuardiaPro AND ITS DEVELOPERS, OWNERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES.
     
     LIMITATION OF LIABILITY: The developer's total liability under this agreement shall not exceed the amount you have paid for the application in the past twelve (12) months, or if no payment was made, fifty dollars ($50), whichever is greater.
     
     DISCLAIMER OF WARRANTIES: The application is provided "AS IS" without warranty of any kind, express or implied. The developer disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the application will be error-free, uninterrupted, or that it will meet your specific requirements.
     
     EMERGENCY SERVICES DISCLAIMER: This application is a supplemental tool and does not replace professional emergency services. Always contact local emergency services directly for life-threatening situations. The developer is not responsible for any delays or failures in emergency response.

3. Indemnification

You agree to indemnify, defend, and hold harmless SiGuardiaPro, its developers, owners, affiliates, and their respective officers, directors, employees, agents, and successors from any and all claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from or related to:
     
     • Your use or misuse of the application
     • Your violation of this agreement or applicable laws
     • Your unauthorized access to or modification of the application
     • Your infringement of any intellectual property or other rights of third parties
     • User-generated content you provide or upload
     • Your breach of security or data protection measures
     
     This indemnification applies to all claims, whether arising in contract, tort, strict liability, or otherwise.

4. Data Collection, Storage & Privacy

SiGuardiaPro's SafeSignal App collects only the data necessary for app functionality, This includes some personally identifiable information such as Account information (name, address, phone number, email, and payment information) all protected via encryption.

A. DATA STORAGE & SECURITY: You, as the user, can strictly manage how your data is stored on your device or to your cloud. The app does have secure servers with industry-standard encryption. We implement appropriate agents, technical and organizational measures, to protect your data and safeguard our users against unauthorized access, alteration, or disclosure. 

B. DATA SHARING: We do not share your personal data with third parties except: • When served with legal process • With emergency services (only when you trigger an SOS alert) • With family members you explicitly authorize through a verified emergency contact set up • With service providers and agents who assist in improving app operation (under strict confidentiality agreements). 

C. PRIVACY POLICY: For comprehensive details on data handling, GDPR rights, CCPA rights, and data deletion procedures, please review our Privacy Policy within the app.

D. USER RIGHTS: You have the right to: • Access your personal data • Control your personal Data• Request deletion of your data • Obtain a portable copy of your data • Withdraw from our services at any time. 

E. DATA RETENTION: Data retention is set up in app, by the user. Data backup is set up in app, by the user. Data deletion is set up in app by the user. You can completely wipe your data at any given time. 

5. User Responsibility & Acceptable Use

You are solely responsible for: 

• Using the application lawfully and in compliance with all applicable laws and regulations • Protecting your login credentials and account access • Monitoring your account activity and promptly reporting unauthorized access     • Backing up your own data and being aware that deleted data cannot be recovered • Ensuring the accuracy of the information you provide • complying with emergency services' instructions when you contact them 

A. PROHIBITED USES: You may not use the application to:

• Commit, facilitate, or promote illegal activities • Harass, threaten, or harm others • Create false or fraudulent emergency reports • Interfere with emergency response services • Upload malware or harmful content • Violate others' privacy or intellectual property rights 

***If you are reported using the app in any of the above listed prohibited manners, your account will be suspended and you will be banned from any future use of the application. You may also face legal repercussions from individuals, in which SiGuardiaPro, may further seek damages for breach of agreement and/or misuse. 

USER-GENERATED CONTENT: You retain ownership of content you create, but grant SiGuardiaPro's SafeSignal App a royalty-free license to use it for emergency response, law enforcement cooperation, and app improvement. The developer is not responsible for monitoring, moderating, or filtering user-generated content and is not liable for any content you or others provide. 

THIRD-PARTY DATA: The developer is not responsible for data obtained from third parties (maps, weather services, location data, etc.). Review third-party terms of service for their policies within the app.

7. Governing Law & Jurisdiction

This agreement shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles. See more in the app.

8. Modifications to This Agreement

SiGuardiaPro reserves the right to modify the user agreement at any time. Material changes will be communicated to you at least thirty (30) days before taking effect. Your continued use of the application after such notice constitutes acceptance of the modified agreement. If you do not accept the modifications, you must terminate your account.

9. Entire Agreement

This Terms and Conditions agreement, together with our Privacy Policy (available in app), and any other documents referenced herein, constitute the entire agreement between you and SiguardiaPro regarding your use of the application and supersedes all prior agreements and understandings.
